Terms & Conditions (California)
1. Copyright Ownership
All photographs and images (“Photos”) are the copyrighted property of A-Star Photography and are protected under United States Copyright Law (Title 17, U.S. Code).
No ownership or copyright is transferred to the client through the purchase or delivery of digital files.
2. License Grant
Upon full payment, A-Star Photography grants the client a non-exclusive, non-transferable license to use the purchased digital photos under the terms outlined below.
This license applies only to the individual or entity listed on the original invoice.
3. Permitted Uses (Personal License)
Unless otherwise stated in writing, the client may:
Download and store the digital photos
Print the photos for personal use
Share photos on personal social media accounts
Display photos on personal websites (non-commercial)
Make reasonable edits such as cropping or resizing (color alterations must not misrepresent the photographer’s work)
📌 Credit is appreciated but not required for personal use.
4. Prohibited Uses
The client may not, without written permission from A-Star Photography:
Sell, license, or redistribute the photos
Use the photos for advertising, marketing, branding, or commercial purposes
Submit the photos to contests, publications, or stock platforms
Alter the photos in a way that misrepresents the photographer’s work
Transfer the photos or license to any third party
Commercial use requires a separate written commercial license agreement.
Photographer’s Promotional Use
The client grants A-Star Photography permission to use the photographs for the photographer’s portfolio, website, studio samples, social media, advertising, marketing, competitions, and promotional materials.
This permission is granted without compensation and is perpetual.
If the client wishes to opt out of promotional use, they must notify A-Star Photography in writing prior to image delivery. Upon written request, the photographer will refrain from using the images for promotional purposes.
6. Commercial Use
Any commercial use—including but not limited to business promotion, paid advertising, product sales, or editorial publication—is strictly prohibited unless a separate commercial license is purchased and agreed to in writing.
7. No Warranty
Digital files are delivered “as is.” While every effort is made to provide high-quality images, A-Star Photography makes no guarantees regarding compatibility with specific devices, printers, or software.
8. Limitation of Liability
To the maximum extent permitted under California law, A-Star Photography shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the digital photos.
Total liability shall not exceed the amount paid for the digital photos.
9. Archiving & File Retention
A-Star Photography does not guarantee long-term archiving of digital files. Clients are responsible for downloading and backing up their images upon delivery.
10. Model Release
If applicable, the client affirms that they have authority from all recognizable individuals in the photos to receive and use the images under this license.
11. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles.
12. Acceptance of Terms
By purchasing, downloading, or using the digital photos, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
